The Independent Financial Advisors Forum (IFAF) has applied for an urgent court interdict to block the City of Johannesburg from proceeding with a tender for a sole medical aid brokerage provider.
The Forum says the process is unlawful and irregular and the tender would unfairly exclude existing brokers from servicing their clients within the City’s workforce and pensioner group. The case is set to be heard at the High Court in Johannesburg tomorrow.
IFAF Deputy Chairperson Buti Sigasa says, “In 2023, the appeal board, was very explicit in providing proper legal interpretation of regulation 28(7) to the effect that a member of a medical scheme, has an inherent right to appoint a broker and that right supersedes that of any other third party, including the employer even in what is loosely referred to as employer groups. So, the legislation is very clear, therefore, it is unthinkable that the City of Johannesburg would want to contravene a very clear legislation.”
