The judge who invalidated an expired R526 million Gauteng health department tender for crucial medical waste disposal services has granted the department the right to appeal his ruling – on the basis that the tender’s expiry may have been challenged too late. 

Gauteng High Court in Johannesburg Acting Judge Ahmed Cajee last year found that the tender for the “Appointment of Service Providers to Render Comprehensive Healthcare Waste Management for the Department of Health Institutions for a Period of Thirty Six Months” had “lapsed because no valid extension of the tender period occurred after 17th November 2022”.

The tender and the Request for Proposals attached to it was, therefore, “of no force or effect”, he said.
